Terms of Service
These Terms of Service (the "Terms") govern your access to and use of SpookyPulse (the "Service"), a Discord bot and web dashboard operated by SpookyCodes ("we", "us" or "our"), an independent software studio based in Italy. By adding the bot to a Discord server or using the dashboard, you agree to these Terms.
1. Acceptance of these terms
By inviting SpookyPulse to a Discord server, logging into the dashboard, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of a server or organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, please do not use the Service.
2. Description of the service
SpookyPulse is an all-in-one Discord bot that combines moderation, ticketing and transcripts, leveling, scam protection and related community-management tools, controlled through a single web dashboard. Features available to you depend on your plan (Free, Pro or Business). We may add, change or remove features over time as the Service evolves.
3. Accounts and eligibility
- Using the Service requires a valid Discord account and access to the servers where you install the bot. Your use of Discord is also governed by Discord's own Terms of Service and community guidelines.
- You must be at least 13 years old, or the minimum age required to use Discord in your country, whichever is higher.
- You are responsible for the activity that happens through the bot on servers you manage, including the actions of your moderators and staff.
- You must not use the Service if you are barred from doing so under applicable law or under Discord's terms.
4. Subscriptions and billing
SpookyPulse offers the following plans:
- Free — €0, no card required.
- Pro — €8.99 per month.
- Business — coming soon. This plan is not yet available to subscribe to; pricing will be announced when it launches.
At launch, the only subscribable plans are Free and Pro. Paid plans (currently Pro) are processed by our payment provider, Stripe. By subscribing, you authorize us, through Stripe, to charge the applicable fees to your chosen payment method. Prices are shown in EUR and may be subject to VAT depending on your location. Business will be available soon.
- Renewal: subscriptions renew automatically at the end of each monthly billing period until cancelled.
- Cancellation: you may cancel at any time from the dashboard. Your paid features remain active until the end of the current billing period, after which the plan reverts to Free.
- Refunds: payments are generally non-refundable, except where a refund is required by applicable law, including mandatory consumer-protection rights under EU law. If you believe you are entitled to a refund, contact us and we will handle your request in good faith.
- Founding offer: the first 10 founding servers receive a 7-day Pro trial as a founders' perk. This is a limited launch offer and not a lifetime price.
5. Acceptable use
You agree not to use the Service to, and not to allow others to:
- Break the law, Discord's terms, or the rights of others.
- Distribute malware, spam, phishing, or other harmful or deceptive content.
- Harass, threaten, or abuse other users, or facilitate such behaviour.
- Attempt to gain unauthorized access to the Service, other servers, or our infrastructure.
- Reverse-engineer, resell, or abusively overload the Service or its API beyond fair use.
We may suspend or terminate access to the Service, in whole or in part, if we reasonably believe these Terms are being violated or that continued use poses a risk to other users, to Discord, or to us.
6. Data and content
You retain ownership of the content in your servers. To provide the Service, we process certain data as described in our Privacy Policy. In particular, ticket transcripts are stored so you can search and reference past support conversations:
- Free plan — transcripts are retained for a limited period (currently 14 days) and then removed.
- Pro plan — transcripts benefit from extended retention, as described on the pricing page and in the dashboard.
- Business plan — even longer retention is planned and will be available when the Business plan launches (coming soon).
You are responsible for ensuring that your use of transcripts and other stored data complies with the laws applicable to your community and its members. You may request deletion of your data as set out in the Privacy Policy.
7. Availability and changes
We work to keep the Service reliable, but it is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation, and availability may depend on third parties such as Discord and our hosting and payment providers. We may modify, suspend, or discontinue features, and we may update these Terms from time to time. When changes are material, we will make reasonable efforts to notify you, for example through the dashboard or the Service. Continued use after changes take effect means you accept the updated Terms.
8. Limitation of liability
To the maximum extent permitted by applicable law, SpookyCodes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your mandatory consumer rights.
9. Governing law
These Terms are governed by the laws of Italy and applicable European Union law, without regard to conflict-of-law rules. Any disputes will be subject to the competent courts, without prejudice to any mandatory consumer-protection rights that grant you the right to bring proceedings in your country of residence.
